These Terms of Service govern your access to and use of askSpeech, including our website, applications, speech-analysis tools, reports, and related services.
Clascity, Inc. operates askSpeech. In these Terms, "askSpeech," "we," "us," and "our" refer to Clascity, Inc..
By accessing or using askSpeech, you agree to these Terms. If you do not agree, do not use the service.
1. The askSpeech service
askSpeech uses artificial intelligence and other software tools to analyze speeches and speech-like content. Depending on the features available, the service may provide:
- Speech structure analysis
- Clarity and organization feedback
- Scoring and evaluations
- Identification of strengths and weaknesses
- Quotations and excerpts from submitted content
- Suggested revisions or alternative outlines
- Delivery, engagement, audience, and practical-application feedback
- Sermon, educational, political, professional, or general-speaking analysis
- Other AI-generated observations and recommendations
The service is designed to support reflection and improvement. It does not replace professional judgment.
2. Eligibility
You must be at least 13 years old to use askSpeech.
If you are under the age of majority where you live, you may use askSpeech only with the permission and supervision of a parent or legal guardian.
By using the service on behalf of a company, church, school, organization, or other entity, you represent that you have authority to accept these Terms on its behalf.
3. Accounts
Some askSpeech features may require an account.
You agree to:
- Provide accurate account information
- Keep your login credentials secure
- Promptly update information that becomes inaccurate
- Accept responsibility for activity performed through your account
- Notify us if you believe your account has been accessed without permission
You may not share an account in a way that avoids applicable usage limits, seat limits, or charges.
4. Content you submit
"User Content" includes transcripts, YouTube URLs, text, files, recordings, titles, descriptions, prompts, feedback, and other material that you submit to askSpeech.
You retain any ownership rights you have in your User Content.
You grant askSpeech a limited, worldwide, non-exclusive licence to host, copy, transmit, process, reproduce, and analyze your User Content only as reasonably necessary to:
- Provide the service
- Generate requested reports and analyses
- Maintain and secure the service
- Provide technical support
- Comply with the law
- Enforce these Terms
This licence ends when the relevant content is deleted from our active systems, except where limited retention is reasonably required for backups, security, fraud prevention, dispute resolution, or legal compliance.
We do not claim ownership of your original speeches, transcripts, recordings, or other submitted material.
5. Your responsibility for submitted content
You are responsible for the content you submit and for having a lawful basis to submit it.
You represent that:
- You own the content, have permission to use it, or are otherwise legally permitted to submit it for analysis
- Your submission does not violate another person's privacy, confidentiality, intellectual-property, publicity, or contractual rights
- You will not submit confidential information that you are not authorized to disclose
- You will not submit private recordings made without legally required consent
- You will comply with applicable laws when using or sharing the resulting analysis
The fact that a speech or video is publicly accessible does not necessarily mean that all uses of it are unrestricted.
When submitting content belonging to another speaker, you are responsible for determining whether your use is lawful.
6. YouTube and third-party sources
askSpeech may allow you to submit links to content hosted by YouTube or another third-party platform.
askSpeech is not affiliated with or endorsed by YouTube, Google, or the creator of any submitted content unless expressly stated.
Third-party content remains subject to the rights of its owner and the terms of the platform hosting it. You are responsible for complying with those terms.
We may be unable to retrieve or analyze content because of availability, geographic restrictions, privacy settings, platform changes, technical limitations, or removal by the original platform.
7. AI-generated analysis
askSpeech uses artificial intelligence. AI-generated results may be incomplete, inaccurate, inconsistent, subjective, or inappropriate for a particular context.
Scores and comments may vary between analyses, even when similar content is submitted.
You should independently review important results before relying on them.
askSpeech does not guarantee:
- The accuracy of any score or observation
- That all factual, theological, historical, political, academic, or technical statements will be correctly assessed
- That every important strength or weakness will be identified
- That suggested language will be original or suitable for publication
- That an analysis will reflect the views of every audience, tradition, profession, or community
- That following the feedback will improve audience reception or professional outcomes
Religious and theological feedback is interpretive and is not a substitute for review by a qualified religious leader or scholar.
The service is not legal, medical, financial, psychological, employment, educational-admissions, or other regulated professional advice.
You may not use askSpeech as the sole basis for a decision that determines another person's employment, education, housing, credit, insurance, legal rights, access to essential services, or similar high-impact opportunity.
8. Generated reports
As between you and askSpeech, and to the extent permitted by law, you may use reports generated specifically for you for personal or commercial purposes.
This does not transfer ownership of:
- Third-party content quoted in a report
- Another speaker's underlying speech
- askSpeech software, interface, branding, scoring framework, prompts, templates, or proprietary methods
- Material that cannot legally be owned or transferred
You are responsible for reviewing generated material before publishing, presenting, selling, or otherwise using it.
Because AI systems may produce similar material for different users, generated reports are not guaranteed to be unique.
9. Prohibited uses
You may not use askSpeech to:
- Break the law or assist another person in breaking the law
- Infringe intellectual-property, privacy, confidentiality, or publicity rights
- Upload malware, malicious code, or content intended to disrupt the service
- Obtain unauthorized access to another account or system
- Scrape, crawl, copy, or systematically extract the service or its reports without permission
- Reverse engineer or attempt to discover non-public prompts, source code, models, or security mechanisms
- Circumvent usage, payment, rate, or access restrictions
- Impersonate another person or misrepresent the source of content
- Harass, threaten, exploit, dox, or unlawfully monitor another person
- Create deceptive endorsements, fabricated quotations, or misleading claims about a speaker
- Use the service for unlawful surveillance or biometric identification
- Resell access to askSpeech without written permission
- Use automated systems to access the service in a manner that creates an unreasonable load
- Use the service in a way that violates the terms or policies of our technology providers
The analysis of harmful, discriminatory, violent, or otherwise troubling speech for legitimate criticism, education, journalism, research, or moderation is not automatically prohibited. Context and intended use matter.
10. Feedback
You may provide suggestions, ratings, corrections, or other feedback about askSpeech.
You grant us permission to use that feedback to operate, improve, and promote the service without payment or obligation to you.
We will not publicly identify you as the source of feedback without permission.
We will not use the contents of your private speeches or analyses in promotional examples without your express permission.
11. Fees, credits, and subscriptions
Some features may require payment.
Prices, usage limits, included analyses, billing periods, taxes, and other purchase details will be shown before you complete a purchase.
Unless otherwise stated:
- Payments are charged in advance
- Analysis credits have no cash value
- Credits may not be transferred or resold
- A credit may be considered used once processing has begun
- Fees are non-refundable after a paid analysis has been substantially processed, except where required by law
- Subscription plans automatically renew until cancelled
- You may cancel a subscription before the next renewal date
- Cancellation stops future renewals but does not normally produce a refund for the current billing period
- Changes to a subscription may take effect immediately or at the next billing period, as explained when the change is made
We may change prices or plan features. Price changes for an existing subscription will take effect no earlier than the next renewal after reasonable notice, unless a different period is required by law.
Payments may be processed by a third-party payment provider. We do not normally receive or store your complete payment-card number.
12. Intellectual property
askSpeech and its licensors retain all rights in the service, including its:
- Software
- Interface and visual design
- Logos and branding
- Evaluation systems
- Prompts and workflows
- Report structures and templates
- Documentation
- Databases
- Original written and visual material
These Terms do not grant you permission to use askSpeech trademarks or branding except as necessary to identify the service.
13. Privacy
Our Privacy Policy explains how we collect, use, retain, and disclose personal information.
By using askSpeech, you acknowledge that your content may be processed by third-party hosting, artificial-intelligence, analytics, payment, communications, and security providers as described in the Privacy Policy.
14. Service changes and availability
We may modify, add, remove, suspend, or discontinue features.
We do not guarantee that:
- The service will always be available
- Every video or transcript can be processed
- Processing will complete within a particular time
- Reports will be stored permanently
- A particular AI model or provider will remain available
- Existing features or pricing will remain unchanged
We may establish reasonable usage limits to protect the service and other users.
15. Suspension and termination
You may stop using askSpeech at any time.
We may restrict, suspend, or terminate access when we reasonably believe that:
- You violated these Terms
- Your use creates a legal, security, or operational risk
- Payment is overdue or reversed
- Your activity threatens another user or third party
- We are required to do so by law or by a service provider
- The service or relevant feature is being discontinued
Where practical, we will provide notice and an opportunity to correct the issue. Immediate action may be taken when necessary to prevent harm, fraud, security incidents, or legal violations.
Sections that should reasonably survive termination will continue to apply, including ownership, disclaimers, liability limitations, indemnification, and dispute provisions.
16. Disclaimers
To the maximum extent permitted by law, askSpeech is provided "as is" and "as available."
We disclaim all warranties and conditions not expressly stated in these Terms, including implied warranties or conditions of merchantability, fitness for a particular purpose, accuracy, title, non-infringement, and uninterrupted availability.
Nothing in these Terms excludes a warranty, condition, right, or remedy that cannot legally be excluded.
17. Limitation of liability
To the maximum extent permitted by law, askSpeech and its directors, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, reputation, opportunity, or goodwill.
Our total liability arising from the service or these Terms will not exceed the greater of:
- The amount you paid to askSpeech during the six months before the event giving rise to the claim, or
- CAD id="root"00
These limitations do not apply where liability cannot legally be limited, including liability arising from fraud, wilful misconduct, or another category that applicable law does not permit us to exclude.
18. Indemnification
To the extent permitted by law, you agree to compensate askSpeech for claims, losses, liabilities, and reasonable expenses arising from:
- User Content you submit
- Your unlawful or unauthorized use of third-party content
- Your violation of these Terms
- Your infringement of another person's rights
- Your misuse of an askSpeech report
This section does not require you to compensate us for losses caused by our own fraud, wilful misconduct, or violation of law.
19. Governing law
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict-of-law principles.
The courts located in British Columbia will have jurisdiction over disputes, except where the consumer-protection laws of your location give you the right to bring a claim elsewhere.
Before starting formal proceedings, you and askSpeech agree to make a reasonable effort to resolve the dispute informally by written notice.
20. Changes to these Terms
We may update these Terms to reflect changes to the service, law, security practices, providers, or business operations.
We will post the updated Terms and revise the effective date.
For material changes, we will provide reasonable notice through the service, by email, or through another appropriate method. Continued use after the updated Terms take effect constitutes acceptance where permitted by law.
21. General provisions
If any part of these Terms is found unenforceable, the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver of that provision.
You may not transfer your rights or obligations under these Terms without our permission. We may transfer these Terms as part of a merger, restructuring, financing, acquisition, or sale of the service or business.
These Terms and the Privacy Policy form the entire agreement between you and askSpeech regarding the service, unless another written agreement applies.
